Filing a Fatal Car Accident Claim in Charlotte, NC

If your family member was killed in a crash with another driver, you may be able to bring a claim on his or her behalf. North Carolina is an “at-fault” state with regard to car accidents, which means that a crash victim can generally file a claim against a driver whose careless or reckless actions cause a collision or accident. Similarly, North Carolina’s laws also allow certain individuals to file a wrongful death lawsuit when a person is killed in a fatal accident. However, there are strict rules limiting who may file a claim, when the claim can be filed, and what the victim or victim’s representative must prove in order to be compensated.

Because of a law called the “statute of limitations,” there are strict time limits for filing a wrongful death claim in North Carolina. Specifically, the statute of limitations allows two years from the date of death to file a claim. While it is never easy to face, it is important to act as quickly as possible, as delays can seriously weaken the case or even cause the claim to be barred.

Additionally, there are laws controlling who may bring a claim. Though many people can be deeply affected by the crash victim’s death, only the crash victim’s representative has the legal authority to sue for wrongful death after a car accident in Charlotte.

Average Wrongful Death Lawsuit Settlements

To receive compensation for a fatal car accident, the plaintiff or claimant must use evidence to show that the following facts are true:

  • The other driver breached his or her duty to drive safely by acting in a careless or reckless fashion. Some common examples of this might include driving under the influence, speeding, driving while texting, falling asleep at the wheel, driving the wrong way down a one-way street, following too closely, failing to signal, failing to yield, and other errors.
  • The other driver’s actions – or in some situations, the other driver’s lack of action – caused the accident to occur.

Obviously, there is no way to put a monetary value on human life, and no amount of compensation can make up for the loss of the person. However, it is important to take many factors into account when calculating damages.

  • The deceased person’s age and health when the crash occurred
  • The deceased person’s former earning capacity
