Charlotte Boating Accident Lawyer

Charlotte’s residents are just a few hours away from North Carolina’s gorgeous coastline, which opens onto the warm waters of the Atlantic Ocean. Additionally, the state is dotted with pristine lakes and rivers, such as Lake Norman, Mountain Island Lake, Lake Wylie, and the Catawba River. This makes North Carolina a prime destination for boating and swimming – but on the other hand, it also creates opportunities for boating accidents, especially when boat operators are intoxicated or inexperienced.

NC Boating Accident Statistics

Every year, the North Carolina Wildlife Resources Commission (NCWRC) publishes a report on boating accidents and fatalities. According to the 2016 report, there were 147 boat accidents in North Carolina that year, down slightly from 166 in 2015. However, while the total number of accidents decreased, the number of fatal accidents climbed. In 2015, 21 out of 166 accidents were fatal (12.7%), while in 2016, 22 out of 147 accidents were fatal (15%).

Of all the counties in North Carolina, Mecklenburg County had one of the highest boating accident figures, accounting for 12 of the documented crashes. In most counties, this number was 0 or in the single digits. Two of the 12 crashes (16.7%) involved alcohol, which – as these statistics illustrate – is often a factor when boating accidents occur. Just as it is illegal to drive under the influence of drugs or alcohol, it is also unlawful to operate a boat while intoxicated. When boaters ignore these laws, the risk of a high-speed collision increases.

Boat Injury Lawsuits, Settlements, and Compensation

Boating injury victims can feel lost and overwhelmed when an accident occurs. While most people are somewhat familiar with the insurance requirements around auto accidents, boating accident claims are controlled by their own unique and highly specialized set of facts.

If you were injured in a boating accident, it is crucial to choose an attorney who has the appropriate experience and qualifications to handle your claim effectively. At Dewey, Ramsay & Hunt, P.A., we are well-versed in accident liability laws, and understand how to help the victims of serious boat accidents recover compensation for their injuries.

If we handle your claim, we will immediately start working to preserve key evidence. We can also obtain medical records, photograph and analyze the wreckage, and work to locate any witnesses who might have seen your vessels collide.

Throughout the process, we will prioritize maximizing your recovery. Medical bills are the last issue you should have to worry about when you are coping with serious injuries, and we will negotiate aggressively for a fair settlement. We may be able to recover compensation for:

  • Lost wages and income, including reductions to your future earning capacity
  • Medical treatment costs, including anticipated medical expenses, such as hospitalization, surgery, medication, doctor appointments, rehabilitative care, prosthetics, medical equipment such as wheelchairs, and transportation to and from medical facilities
  • Pain and suffering caused by your injuries

When a boating accident is fatal, the victim’s surviving loved ones may wish to file a wrongful death lawsuit. Wrongful death claims allow claimants to seek similar damages, in addition to funeral and burial costs. Wrongful death cases also allow plaintiffs to recover compensation for the lost financial value of the services and support the victim provided.

OUR PHILOSOPHY

When a new client comes to our office, they are not handed off to a paralegal. One of our attorneys meets with each new client personally on their first visit to our office. We will discuss the merits of your case with you, listen carefully to your concerns, and answer your questions at that time, without any obligation on your part.

We generally only accept those cases that we are willing to take all the way to trial. Many of our clients have come to us from other attorneys who only want to settle cases as quickly and as easily as possible. While settlements are generally desirable and we encourage them, some cases need to go through the litigation process to achieve their full value. The decision to file a lawsuit is made by the client after a full discussion of all relevant factors.
